This cancellation and retreat policy is crafted to accommodate changes in plans while respecting commitments to partners and vendors. It applies to all cancellation scenarios without exceptions, while offering understanding and compassion towards unforeseen changes.
CANCELLATION BY PARTICIPANT
Please be aware that Let's Jess Be Here LLC does not provide refunds for cancellations under any circumstances. However, you have the option to transfer your spot to a friend or family member at any time. The individual to whom you transfer your spot will be responsible for directly reimbursing you for the payments you have already made. Let's Jess Be Here LLC will charge the new participant only for any outstanding payments from the original participant, if applicable.
If you are unable to find a replacement, we will attempt to do so. However, we will only advertise available spots to new attendees if there are MORE than 90 days until the retreat begins. If we find a replacement in this period, you will be issued a credit to use towards a future Yoga retreat with Let's Jess Be Here LLC. To clarify, you will still not receive a refund from Let's Jess Be Here LLC even if your spot is filled. If no replacement is found, your payment will be forfeited.
For cancellations WITHIN 90 days of the retreat start date, payments can only be transferred to a friend or family member, who will be responsible for directly reimbursing you for the payments you have already made, and fulfilling any outstanding payments from the original participant, if applicable. If you are unable to find a replacement within this period, we will not attempt to fill the spot for vou and vour payments will be forfeited. We
strongly recommend purchasing travel insurance for unforeseen circumstances.
In the scenario where you've booked a double room for the Yoga Retreat with a companion, your friend/roommate retains the option to refuse the substitution of your spot in the room with a new Yoga Retreat attendee.
CANCELLATION BY LET'S JESS BE HERE LLC
Upon receipt of your deposit, the outstanding balance will be divided into monthly installments, each due on the 20th of every month, with the final payment scheduled for September 20, 2024. If a participant does not make a payment by the designated due date, Let's Jess Be Here LLC reserves the right to cancel their registration for the retreat. No refund will be provided in this case.
In the rare event of a cancellation by Let's Jess be Here LLC due to dangerous weather, political unrest, and other force majeure events (see below), any refund provided will depend on Let's Jess Be Here LLC receiving a refund from the venue. Let's Jess Be Here LLC cannot compensate participants for airfare, hotel and travel costs incurred. To cover these risks, it is strongly recommended that all participants purchases travel insurance.
Let's Jess Be Here LLC also reserves the right to refuse or cancel a participant's registration for any reason. In this case, a full refund will be provided.
DELAYS AND OTHER UNFORSEEN CIRCUMSTANCES
There will be no refunds nor discounts for arriving late, leaving early, flight cancellations, travel delays or illness. For additional protection due to any unforseen circumstances, it is highly recommend that all participants purchase travel insurance at the time of booking the retreat. Let's Jess Be Here LLC is not liable for any injuries, accidents, or illnesses that may occur during the retreat. Participants are responsible for their own well-being and should consult with a doctor before participating in any physical activities during the retreat. To safeguard against these risks, we strongly recommend purchasing travel insurance.
TRAVEL INSURANCE
Travel insurance can protect participants against participant cancellation, Let's Jess Be Here LLC cancellation, lost or delayed baggage, medical expenses and the cost of repatriation should the participant become ill or injured. It is strongly recommended that all participants purchase travel insurance, including a 'cancel for any reason' option in order to protect them against the rare chance of cancellation. Let's Jess Be Here LLC is not responsible for any expenses or losses incurred due to a participant's decision not to purchase travel insurance. Participants should carefully consider their own personal circumstances and needs when deciding whether or not to purchase travel insurance.
RETREAT INFORMATION
o Let's Jess Be Here LLC is not responsible for any lost or stolen personal belongings during the retreat.
o Any personal expenses or activities not included in the retreat package are the responsibility of the participant.
o Let's Jess Be Here LLC is not responsible for any cultural or weather-related differences that mav affect the retreat experience.
o Participants should also be aware of any potential health or safety risks associated with traveling to Thailand, such as vaccinations or travel advisories. It is recommended that participants consult with their doctor before traveling to ensure they are in good health and able to participate in the retreat activities.
o During the retreat, participants will use transportation to and from scheduled activities and excursions. Let's Jess Be Here LLC is not liable for any accidents, injuries, or losses that may occur during transportation to and from these activities.
o Any behavior deemed inappropriate or disruptive to the retreat experience will result in immediate termination of participation, without refund.
o Participants are responsible for their own travel and medical insurance, as well as any necessary visas, passports and travel documents.
o Let's Jess Be Here LLC reserves the right to use any photos or videos taken during the retreat for promotional purposes, unless otherwise specified by the participant.
o Participant's responsibility to inform Let's Jess Be Here LLC of any allergies, medical conditions, or dietary restrictions before the retreat begins.
o By registering for a retreat, participants acknowledge and agree to all terms and conditions outlined in this cancellation policy and this Agreement.
YOGA WAIVER WITH LET'S JESS BE HERE LLC
By participating in the yoga classes during the retreat, participants acknowledge and understand that there are certain inherent risks involved in physical activities, including but not limited to yoga. These risks may include, but are not limited to, muscle strain, falls, and injuries related to physical exertion. Participants understand that it is their responsibility to inform the instructor of any pre-existing injuries or medical conditions before participating in any physical activities during the retreat. It is also their responsibility to listen to their body and not push themselves beyond their physical limits. Participants understand that the yoga classes during the retreat are not a substitute for medical treatment, and it is recommended that they consult with a doctor before participating if they have any concerns about their physical ability.
In the event of any injuries or health issues that may arise during the retreat, participants agree to hold Let's Jess Be Here LLC, its owners, officers, employees, agents and affiliates harmless from any loss, cost (including attorneys’ fees), damage, expense and liability in connection with claims, judgments, damages, penalties, fines, liabilities, losses, suits, administrative proceedings related to this Agreement.. This indemnity will survive the termination of this Agreement
By participating in the yoga classes during the retreat, participants also understand and agree to follow all safety instructions and precautions provided by the instructor. Any behavior deemed unsafe or not in accordance with the instructions may result in immediate termination of participation in the class. In the rare event of a medical emergency during a yoga class, participants authorize Let’s Jess Be Here LLC, ,or anyone affiliated with the LLC, to seek medical treatment on their behalf and agree to be responsible for any associated expenses. By registering for the retreat and participating in the yoga classes, participants acknowledge and agree to all terms and conditions outlined in this yoga waiver.
MASSAGE THERAPY DISCLAIMER
During the retreat, participants may have the option to receive massage therapy services from a third-party provider. Let's Jess Be Here LLC is not responsible for these services and does not have any control over the quality or safety of the services provided. Participants understand that massage therapy involves certain risks and have the right to refuse any services they feel uncomfortable with. Any issues or concerns regarding massage therapy services must be addressed directly with the third-party provider and will be subject to the laws and regulations of the country where the services are rendered. By participating in massage therapy services during the retreat, participants acknowledge and agree to release and hold Let's Jess Be Here LLC, its owners, officers, employees, agents, and affiliates harmless from all liability for any damages, injuries, or losses that may arise from these services.
EXCURSIONS + INTERNATIONAL TRAVEL
Participants understand that the retreat may include excursions to various locations and activities, including but not limited to temple visits, elephant sanctuaries, and night markets. These excursions may involve certain risks, including but not limited to transportation, physical activities, and interactions with animals. Participants acknowledge and agree that Let's Jess Be Here LLC is not responsible for any accidents, injuries, or losses that may occur during these excursions. Participants are responsible for abiding by the laws and customs of the retreat location and will be held accountable for any violations. Participants are responsible for their own safety and should use caution and common sense when participating in these activities. By participating in the retreat and its excursions, participants acknowledge and agree to release and hold Let's Jess Be Here LLC, its owners, officers, employees, agents, and affiliates harmless from all liability for any damages, injuries, or losses that may arise from these services.
REGISTRATION REQUIREMENTS
All participants must be 18 vears or older.
In addition to the cancellation and retreat policy outlined above, all participants are required to sign and fulfill a payment contract upon registering for the retreat. This contract states that participants will make all payments as scheduled and on time, and failure to do so may result in cancellation of their registration without refund. By registering for the retreat and signing the payment contract, participants acknowledge and agree to fulfill their financial obligations as outlined.
RETREAT PACKAGE DETAILS
As part of this agreement, you will be entitled to the following. Arrival and departure airport transfers, seven nights and eight days of accommodation at the luxurious Saraphi House Villa, three daily vegetarian Thai meals, and daily yoga and meditation classes led by Jessica Thompson of Let's Jess Be Here LLC. Additionally, you will have access to yoga workshops and experiences, as well as all necessary equipment such as mats and props. The retreat also includes one 60-minute Thai massage, a full day at the renowned Sky Walk at Elephant Nature Park, an on-site sound bath experience, and a half-day interactive Thai cooking class. You will also have the opportunity to visit temples, markets, and waterfalls, with transportation provided for all excursions.
NOT Included: Flights, Travel insurance, Additional snacks or drinks outside of meal times (at markets, etc.) and Personal shopping or any additional personal services, etc.
FORCE MAJEURE. If Let's Jess Be Here LLC cannot carry out, either in whole or in part, its obligations, Let's Jess Be Here LLC will not be deemed in default during the continuation of the inability, provided that it is due to an event not within the reasonable control of Let's Jess Be Here LLC which precludes it from carrying out its obligations under this Agreement, including, but not limited to: Acts of God, acts of nature, natural disasters, epidemics, quarantines, public health emergencies, product shortages, transportation shortages, strikes, lock-outs, industrial disturbances, acts of public enemies, insurrections, military action, war, sabotage, riots, civil disturbances, explosions, acts by a governmental authority. Let's Jess Be Here LLC will use commercially reasonable efforts to remedy the cause preventing it from carrying out its obligations, and it may not assert Force Majeure to excuse it from performing where it was reasonably within their power to avoid the act. If an event continues over thirty days, Let's Jess Be Here LLC may terminate this contract.
LEGAL DISCLAIMER

Participants are advised to seek their own legal counsel for any specific questions or concerns regarding this policy. Participants agree to hold Let's Jess Be Here LLC, its owners, officers, employees, agents and affiliates harmless from any loss, cost (including attorneys’ fees), damage, expense and liability in connection with claims, judgments, damages, penalties, fines, liabilities, losses, suits, administrative proceedings related to this Agreement. This indemnity will survive the termination of this Agreement
LIMITATION OF LIABILITY. Let's Jess Be Here LLC, and its respective directors, officers, agents, and employees, will not be liable for any special, indirect, punitive, consequential, or incidental damages arising under this Agreement. If any claim is adjudged and a judgment or binding arbitration award is entered against Let's Jess Be Here LLC, the judgment or award will not exceed the amount paid to it. This limitation of liability will apply regardless of the cause of action where such damages are sought, including, without limitation, breach of contract, negligence, warranty, indemnification, tort, or strict liability.
This Agreement sets forth the Parties’ entire understanding. This Agreement will be construed under the laws of the Commonwealth of Massachusetts. If any provision is held to be invalid, illegal, or unenforceable, the remaining portions will remain in full force and effect and construed best to effectuate the original intent and purpose of the Parties. If a Party brings any legal action regarding the enforcement of this Agreement and is successful, they may recover their reasonable attorney’s fees from the other party, besides any other relief granted. The Parties agree that any action to interpret or enforce this Agreement or arises out of this Agreement will be brought in any court in Middlesex County, Massachusetts.
NON-DISPARAGEMENT: The Parties agree to not disparage or make negative comments regarding the other party or their respective business, directors, officers, affiliates, shareholders, employees, or agents to any person, whether during or after the Agreement.
